Electric Bike Injury Lawyer

An Elite Team That Stands Behind You.

Risk-Free Representation – No Fees Unless We Win Your Case!

Urban lifestyle has embraced E-bikes and scooters as a cost-effective and low-impact way to get around New York City. Now that all three classes of E-bikes have become legal and as they continue to sprout up around the city, so have accidents that leave their riders financially devastated and seriously injured.

Like regular bikes, E-bikes riders lack the safety protections of cars, leaving them far more vulnerable in the case of accidents. Even when hit at relatively low speeds by a motor vehicle, the electric bike rider can sustain serious and even life-threatening injuries. If you have bicycle accident injuries in New York and had to spend time at the hospital, the NY electric bike injury lawyers at Kucher Law can help you get the compensation you deserve for your personal injuries.

How E-bikes are Defined in New York City

E-bikes are bikes that have integrated motors designed for propulsion. New York City has defined an electric bicycle as a bike that is no more than 36 inches wide with an electric motor of less than 750w with fully functioning pedals.

Recently, all categories of electric bikes were legalized in New York which was a great victory for those who use them throughout the city.

The new laws have created three distinct classes of these electric bicycles:

  • Class 1 E-bikes are pedal-assist bikes that travel at a maximum of 20 miles per hour. A helmet is recommended for all riders but required for riders who are 16-17 years old or working cyclists.
  • Class 2 E-bikes are throttle-powered bikes with operable pedals that travel at a maximum of 20 miles per hour. A helmet is recommended for all riders but required for riders who are 16-17 years old or working cyclists.
  • Class 3 E-bikes are throttle-powered bikes with operable pedals that travel at a maximum of 25 miles per hour. Helmets are required for everyone for Class 3 E-bikes.

Those who ride electric bicycles can do so in bike lanes and on streets with speed limits of 30 MPH or under. No driver’s licenses are required.

Class of E-bikeMaximum SpeedHelmet Requirements
Class 1 (Pedal-assist)20 mphRecommended; required for riders aged 16-17 and working cyclists
Class 2 (Throttle-powered)20 mphRecommended; required for riders aged 16-17 and working cyclists
Class 3 (Throttle-powered)25 mphRequired for all riders

I was in an accident about a couple of years ago, and I was injured really badly. I went to a different law firm but they didn’t actually appear to care too much someone told me about this personal injury lawyer and said to come here instead. They were so nice, I’m so thankful I made the switch. After I changed my car accident lawyer, the entire process moved a lot easier and I was able to get a great settlement and received it quickly too. Definitely happy with my experience and will tell everyone to go here.

The Increased Dangers of Electric Bikes in New York City

While the popularity of E-bikes in the city has soared, their dangers in accidents scenario continue to become more apparent.

Data throughout the United States has shown an increasing number of injuries with a higher risk of serious injuries over a traditional bike. A study published by Injury Prevention in December 2019 used a national database of emergency room visits to collect information regarding E-bike accidents, motorized scooter accidents, and standard bikes.

Their findings showed that:

  • Electric bicycle riders are more likely to experience serious internal injuries requiring hospitalization.
  • Electric bicycle riders have higher rates of traumatic brain injuries in an accident.
  • Electric bicycle injuries are three times as likely to involve a pedestrian.
  • Electric bicycle injuries tend to be more severe than those from traditional bike accidents.

The Consumer Product Safety Commission has recently reported that injuries from E-bikes, E-scooters, and hoverboards have jumped by 70 percent since 2017 and have resulted in 71 fatalities over the four years prior to their report.

While it is not known why individuals tend to hurt themselves more seriously on E-bikes than other riders, it is presumed that the vehicle’s speed has much to do with that. Increased speed makes for a more intense impact and more serious injuries.

If you were injured on an E-bike in New York City, it is important to get the help of a bike accident lawyer. At Kucher Law, personal injury lawyer Samantha Kucher and our experienced personal injury team will thoroughly investigate your accident and help hold the at-fault party liable for your damages.

If individuals have been injured in E-bike accidents in New York City, they may be entitled to compensation from the at-fault party.

Parties that can be held liable for damages can include:

  • Motorists – One of the greatest dangers to someone riding an E-bike is being hit by a motor vehicle. Similar to a traditional bike, the E-biker lacks protection and is highly vulnerable in accidents with a full-sized vehicle. E-bikes riders can hold a negligent driver liable for serious injuries and other damages.
  • Pedestrians and other cyclists – If your accident was caused by a negligent pedestrian or cyclist, that person may be held liable for your damages.
  • The E-bike manufacturer – A defective E-bike can cause serious injuries. Manufacturers, distributors, or parts manufacturers can be held liable when their products cause injuries to E-bicycle riders.\

If you believe that your New York City bike accident was caused by the negligence of a driver, another rider, a pedestrian, or the E-bike manufacturer, you may have the right to bring a claim against that party. Call the skilled NYC electric bike accident attorneys at Kucher Law to understand your legal rights after E-bike accidents in New York City.

Product Liability and Electric Bike Accidents in New York

Consumer Reports have reported that NY has witnessed a sharp increase in E-bikes fires. Manufacturers and distributors may be held liable if there is a defect in the product that has led to an accident.

You may have a product liability claim if the following applies:

  • The E-bike had a design defect that occurred in the design process – If you were using the E-bike in the proper way and a defective design caused an accident resulting in injuries, you may have a claim against the product designer.
  • The E-bike had a manufacturing defect that happened during the manufacturing of the bike – If you were using the E-bike appropriately and a manufacturing defect caused your accident and injuries, the manufacturer may be held liable.
  • Failure to warn – A manufacturer, retailer, or another party in the chain of commerce is responsible for warning consumers when they are aware of a safety issue with the product. If you have been injured because there was no safety warning associated with the electric bicycle, liability may fall on a number of parties.

Defects that have been common to E-bikes recently include fires, tire blowouts, front-wheel hub fork failure, motor or controller malfunctions, bearing lock-ups, sticking throttles, and battery issues. Holding E-bikes manufacturer, designer, or retailer liable for your damages can be complicated and requires proof of the defect.

At Kucher Law, injury attorney Samantha Kucher and our New York City E-bike injury lawyers will immediately launch an investigation into the accident to ensure that you get the compensation you deserve for your injuries.

When it comes to e-bike accidents, whether the electric bike is owned or rented can influence liability.

There are numerous brands of e-bikes available on the market, such as Van Moof, Cannondale, Tern, and BromptonElectric. Additionally, you can rent e-bikes from places like Rent Bike NYC, and Citi Bike. Regardless of the brand or rental source, the distinction between ownership and rental can affect legal outcomes following an accident.

If you were riding a rental e-bike at the time of the accident, the rental company might be held responsible under certain conditions. This could happen if the accident was caused by a defect in the bike or inadequate maintenance. On the other hand, if you own the e-bike, the liability typically falls on the party who caused the accident, whether it be another cyclist, a driver, or some other factor.

While the immediate concern after an accident is your health and safety, the ownership status of the e-bike can play a significant role in determining liability and the course of legal action. Understanding these nuances is crucial when seeking compensation for injuries. The electric bike injury attorneys at Kucher Law can adapt their strategies based on the ownership status of the e-bike to better pursue your case and further ensure you receive the compensation you deserve.

Just like in a traditional NYC bike accident, an E-bike accident can have various causes, including:

  • Negligent motorists
  • Negligent pedestrians
  • Negligence of other E-bike riders
  • Negligent operation of E-bikes
  • Road hazards
  • Lack of visibility
  • Manufacturing defects
  • Battery fires
  • Maintenance failure
  • Dooring
  • Not following traffic rules and regulations
  • Acceleration miscalculation
  • Inexperienced riders
  • Inappropriate lane changes
  • Lack of protected lanes

If negligence was a factor in E-bikes accidents in New York City, the victim may be entitled to financial compensation. Let our experienced electric bike injury attorneys in New York City help you get the compensation you deserve for your injuries.

Even at relatively low speeds compared to motor vehicles, injuries sustained in E-bicycle accidents in New York City can result in severe injuries. Data shows that 65 percent of injuries caused by accidents of NYC E-bikes were orthopedic injuries, usually to the lower extremities.

Common electric bike injuries include:

  • Femur, tibia, and other leg fractures
  • Road rash
  • Lower spinal cord injuries
  • Pelvis fractures
  • Concussions and other traumatic brain injuries
  • Internal organ injuries
  • Arm fractures and other dislocations
  • Head and neck injuries
  • Face injuries
  • Scarring and disfigurement
  • Lacerations and abrasions
  • Fatalities

Serious injuries like these can result in extensive medical costs and other financial damages after an accident involving an electric bike in New York City.

When these accidents involving e-bikes are caused by the negligence of another party, they may be held liable for the damages resulting from these injuries. Getting legal assistance will be critical to ensure that you are fairly compensated for these personal injuries and other costs. At Kucher Law, our NYC electric bike injury lawyers can help you hold the at-fault party accountable for your injuries and protect your legal rights.

When you pursue an accident claim against an at-fault party in New York City, you may be entitled to compensation for:

  • Any emergency transportation

  • Hospitalizations
  • Medical bills
  • Medical equipment
  • Prescriptions
  • Doctors visits
